Terms of Service
Last updated November 1, 2026
These terms govern your use of fest.club, operated by TheWorkCompany. We write them in plain English so festival committees, treasurers, municipal clerks and campus advisors can read them without a magnifying glass. Questions: [email protected].
1. You are the seller of record
Each festival organizer is the sole seller of record (merchant of record) for all tickets, passes, vendor booths, sponsorships and patron memberships sold on their festival page. Paid transactions connect directly to the organizer's own Stripe account via Stripe Connect. fest.club never holds, escrows or commingles organizer funds, and takes 0% of ticket sales. Because payments flow directly to the organizer's Stripe account, the organizer sets their own refund and rain-date policy and is responsible for refunds, chargebacks, 1099-K reporting, and any applicable state or local sales or admissions taxes.
2. All-in upfront pricing and no resale marketplace
Every ticket and vendor booth price displayed on fest.club includes all mandatory platform and application fees on the first screen, as the FTC Rule on Unfair or Deceptive Fees (16 CFR Part 464) and state all-in ticket pricing laws require. fest.club issues primary tickets and passes solely on behalf of the festival organizer and does not operate a secondary ticket resale marketplace.
3. Festival passes and $0-upfront self-funding
Organizers may build their festival page for $0 up front. Community festivals (up to 250 tickets or RSVPs, 1 main stage plus acoustic porches, and up to 15 vendors) are $0 total. For Indie ($99 per festival) and Pro ($299 per festival) plans, organizers may either pay the pass fee up front or let the pass self-fund before paying anything out of pocket:
When self-funding is active, each vendor applicant pays a non-refundable $2.50 application fee to fest.club (always disclosed in the all-in total before payment), while the vendor's booth fee is authorized and charged into the organizer's Stripe account only if the organizer approves the vendor. Each $2.50 application fee reduces the festival's remaining pass balance and stops automatically once the $99 or $299 pass balance reaches $0.00. If the organizer sells a sponsorship package through fest.club while a pass balance remains, the remaining balance is deducted once from that sponsorship payment via Stripe Connect, and 100% of the surplus stays in the organizer's Stripe account.
4. Vendor documents are reviewed, not certified
fest.club provides software to help organizers collect vendor files (such as Certificates of Insurance, health permits and fire inspections) and send automated reminders before recorded expiration dates. fest.club only checks that required file fields are present. Neither fest.club nor TheWorkCompany is an insurance broker, underwriter, municipal inspector or legal advisor, and we never verify or certify that any policy or permit is valid, genuine or adequate. All approval decisions rest with the organizer, and approved records are labeled "Organizer reviewed".
5. Municipal and university procurement (Town and campus plan)
The Town and campus plan ($999 per year for unlimited festivals) is billed as an annual software pass with no automatic credit-card renewal unless explicitly requested by the customer. We provide a signed W-9, accept municipal and university purchase orders and purchasing cards, and build public-facing festival schedules and forms in semantic HTML designed to meet WCAG 2.2 Level AA standards.
6. Acceptable use and limitation of liability
You agree not to use fest.club for unlawful, fraudulent or deceptive events. Because fest.club provides software at flat community rates ($0 to $999) and takes 0% of ticket revenue, fest.club provides the service "as is" and, to the maximum extent permitted by law, TheWorkCompany's total aggregate liability for any claim arising out of or relating to fest.club is limited to the greater of $100 USD or the total pass fees paid to fest.club for the affected festival in the twelve (12) months preceding the claim.
